Terms & Conditions
These Terms & Conditions (“Terms”) govern your access to and use of Fixly, a service operated by Gleam & Glow LLC, doing business as Fixly (“Fixly,” “we,” “us,” or “our”), including getfixlynow.com and support provided by SMS, MMS, email, automated systems, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Important: Fixly provides informational, troubleshooting, and practical support. Fixly is not an emergency service, licensed contractor, mechanic, electrician, medical provider, attorney, or other regulated professional unless expressly stated otherwise for a specific service.
1. Eligibility and Acceptable Use
You must be legally capable of entering into a binding agreement to use the Services. You agree to use Fixly only for lawful purposes and not to misuse the Services, interfere with their operation, attempt unauthorized access, submit malicious code, impersonate another person, or use the Services in a way that could harm Fixly, its users, or third parties.
2. Nature of the Service
Fixly is designed to help users understand everyday problems, identify items, troubleshoot devices and household issues, obtain step-by-step guidance, locate relevant information, and determine reasonable next steps. Guidance may be generated or assisted by automated systems and artificial intelligence and may rely on information, descriptions, photographs, audio, model numbers, or other materials you provide.
Fixly does not guarantee that any diagnosis, identification, recommendation, instruction, product information, or troubleshooting step is complete, accurate, suitable for your circumstances, or successful. You remain responsible for deciding whether and how to act on information provided through the Services.
3. Safety and Professional Assistance
Do not use Fixly as a substitute for emergency services or qualified professional assistance where the circumstances reasonably require it. If a situation involves fire, gas, exposed or high-voltage electricity, structural instability, hazardous chemicals, serious vehicle-safety conditions, medical emergencies, threats to personal safety, or another urgent hazard, stop work and contact the appropriate emergency service or qualified professional.
Fixly may recommend that you stop a task or obtain professional help. You agree not to disregard safety warnings or attempt work beyond your training, ability, tools, or lawful authority.
4. SMS and MMS Program Terms
Fixly may provide customer-requested support, service updates, follow-up questions, and related communications by SMS and MMS. Message frequency varies based on your interactions with Fixly and the support you request. Message and data rates may apply depending on your wireless plan.
By opting in to recurring SMS or MMS communications from Fixly, you authorize Gleam & Glow LLC d/b/a Fixly to send messages to the mobile number you provide. Consent to receive recurring text messages is not a condition of purchasing goods or services.
You may opt out of recurring SMS/MMS messages at any time by replying STOP. You may reply HELP for assistance. After you send STOP, we may send one final confirmation message. You may later opt in again through an available Fixly opt-in method.
Wireless carriers are not liable for delayed or undelivered messages. Delivery may depend on your carrier, device, network availability, and other factors outside Fixly's control.
5. Messaging Consent and Privacy
Your mobile phone number, SMS/MMS opt-in information, and messaging consent will not be sold or shared with third parties or affiliates for their marketing or promotional purposes. Our handling of personal information is further described in the Fixly Privacy Policy, which is incorporated into these Terms by reference.
6. User Content
You may submit text, photographs, screenshots, audio, files, descriptions, device information, and other content (“User Content”). You represent that you have the right to provide that content and that your submission does not violate another person's rights or applicable law.
You grant Fixly a limited, non-exclusive right to process, reproduce, transmit, and use User Content as reasonably necessary to provide, secure, maintain, and improve the Services, comply with law, and perform the purposes described in our Privacy Policy. You retain ownership of your User Content.
Do not send passwords, authentication codes, Social Security numbers, financial-account credentials, medical records, or other highly sensitive information unless specifically necessary and appropriate for an offered service.
7. Automated and AI-Assisted Responses
Some Fixly responses may be produced or assisted by automated systems or artificial intelligence. Automated systems can misunderstand context, images, device conditions, model variations, or safety risks. You should independently verify important information, follow manufacturer instructions where available, and use qualified professional help when appropriate.
8. Third-Party Products, Information, and Services
Fixly may reference third-party products, websites, manuals, service providers, manufacturers, or other external resources. Those third parties are independent from Fixly unless expressly stated otherwise. We do not control and are not responsible for their products, availability, statements, practices, warranties, prices, or services.
9. Beta and Experimental Features
Fixly may offer beta, pilot, experimental, or pre-release features. Such features may change, contain errors, be interrupted, or be discontinued without notice. Feedback regarding beta features may be used to improve the Services.
10. Service Availability and Modifications
We may modify, suspend, restrict, or discontinue any part of the Services at any time. We do not guarantee uninterrupted, error-free, secure, or continuously available service. Maintenance, third-party outages, telecommunications failures, internet conditions, or other events may affect availability.
11. Fees and Payment
Certain Fixly services may be offered for a fee now or in the future. Any applicable pricing, payment obligations, subscriptions, refunds, or additional terms will be disclosed before purchase or enrollment. Unless otherwise stated in writing, you are responsible for applicable taxes and third-party telecommunications or data charges.
12. No Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” FIXLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, COMPLETE, SAFE FOR EVERY CIRCUMSTANCE, OR THAT ANY PARTICULAR RESULT WILL BE ACHIEVED.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLEAM & GLOW LLC, FIXLY, AND THEIR MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF USE, PROPERTY DAMAGE, PERSONAL INJURY, OR OTHER LOSSES ARISING FROM OR RELATED TO YOUR USE OF OR RELIANCE ON THE SERVICES, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
Where liability cannot be fully excluded, liability will be limited to the maximum extent permitted by applicable law.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Gleam & Glow LLC d/b/a Fixly and its members, managers, employees, contractors, and service providers from claims, losses, liabilities, damages, and expenses arising out of your unlawful misuse of the Services, violation of these Terms, or violation of another person's rights.
15. Intellectual Property
The Fixly name, branding, website design, original content, software, workflows, and other materials provided by Fixly are owned by or licensed to Gleam & Glow LLC and are protected by applicable intellectual-property laws. These Terms do not grant you ownership of Fixly intellectual property.
16. Termination
We may suspend or terminate access to the Services where reasonably necessary for security, fraud prevention, legal compliance, abusive conduct, material violation of these Terms, or protection of Fixly or others. Provisions that by their nature should survive termination will remain in effect.
17. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise. Any dispute will be subject to the jurisdiction and venue provided by applicable law.
18. Changes to These Terms
We may update these Terms periodically. The revised Terms will be posted on this page with an updated effective or revision date. Where required by law, we will provide additional notice or obtain consent before material changes become effective.
19. Severability and Entire Agreement
If a provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the extent permitted by law. These Terms, together with the Privacy Policy and any service-specific terms presented to you, constitute the agreement governing your use of the Services.
